1. Acceptance of Terms
By accessing or using the LuxeNest Decor website or engaging our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not use our website or engage our services.
2. Services
LuxeNest Decor provides interior and poolside decoration and design services throughout the United States. The scope, timeline, and deliverables of each project are defined in a separate written Project Agreement between LuxeNest Decor and the client. These Terms govern the overall relationship; the Project Agreement governs individual engagements.
3. Quotes and Pricing
Pricing shown on our website represents starting estimates and is not a binding offer. Final pricing is provided after an initial consultation and assessment of your specific project. All quotes are valid for 30 days from the date of issue. Prices are subject to change without notice for new inquiries.
4. Payment Terms
Unless otherwise specified in your Project Agreement:
- A 50% deposit is required before work commences
- The remaining balance is due upon project completion and delivery
- Late payments are subject to a 1.5% monthly finance charge
- All payments are non-refundable once work has commenced, except as otherwise stated in the Project Agreement
5. Client Responsibilities
The client agrees to provide timely access to the property, make decisions promptly to avoid project delays, and communicate changes in scope in writing. Delays caused by the client may result in revised timelines and additional charges.
6. Intellectual Property
All design concepts, mood boards, drawings, and materials created by LuxeNest Decor remain our intellectual property until full payment is received. Upon receipt of final payment, the client receives a license to use the completed designs for their personal, non-commercial use. LuxeNest Decor reserves the right to photograph completed projects for portfolio and marketing purposes, subject to the client's reasonable approval.
7. Limitation of Liability
LuxeNest Decor shall not be liable for indirect, incidental, special, or consequential damages arising from the use of our services, including but not limited to delays caused by third-party vendors, manufacturers, or shipping carriers. Our total liability for any claim shall not exceed the total amount paid by the client for the relevant services.
8. Warranties and Representations
We warrant that our services will be performed in a professional and workmanlike manner. We do not warrant that the website is error-free, uninterrupted, or free of viruses or other harmful components. The website is provided "as is" without warranties of any kind, express or implied.
9. Cancellation Policy
Projects may be cancelled by either party with 14 days' written notice. If cancelled by the client after work has commenced, the client is responsible for payment of all work completed to date plus any non-refundable costs already incurred (e.g., custom orders, vendor deposits).
10. Dispute Resolution
Any dispute arising under these Terms shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Los Angeles County, California, under the rules of the American Arbitration Association. These Terms shall be governed by the laws of the State of California.
11. Modifications
We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised date. Your continued use of our website or services after such changes constitutes your acceptance of the revised Terms.
